NEW YORK -- The Federal Trade Commission has ordered Pfizer Inc. to pay $1.25 million to settle allegations that it misled consumers about the risks of its Nexium Nextray, or “Nexium”, which can cause heartburn.

Pfizer settled allegations it marketed a generic version of Nexium for a variety of reasons, including a potential link to heartburn, according to an amended complaint filed today in federal court in New York City. It also charged Pfizer with violating federal law, and ordered the company to pay $2.25 million, the amended complaint says.

“Pfizer’s conduct was consistent with the well-established principle that only a drug’s safety and efficacy will determine the price of a drug. This principle, along with its known adverse effects on consumers, has long been established in the consumer and pharmaceutical industries,” said Michael Lechleiter, a partner at the law firm William Mellen. “The company has a responsibility to ensure the safety and efficacy of this product and to inform consumers of this potential risk.”

Nexium Nextray is a branded version of the generic drug, Prilosec, which is used in the treatment of ulcers and other gastrointestinal disorders. The U. S. Food and Drug Administration (FDA) issued a boxed warning for Nexium, which can cause heartburn and ulcers. The warning states that the drug can lead to a “dangerous and life-threatening condition called persistent acid reflux.”

Pfizer agreed to settle all of these allegations with the USFDA.

Pfizer said the agreement with the USFDA was intended to deter other companies from using its drugs to treat ulcers and other gastrointestinal disorders. The settlement also will provide Pfizer with additional warnings regarding potential risks, the company said.

“Pfizer has engaged in a number of other conduct to ensure that it is following the instructions of its patients,” said Jeffrey Kindler, chief executive officer of the pharmaceutical industry group Consumers Union. “In light of these additional actions by the USFDA, Pfizer’s conduct may be of concern to consumers.”

The amended complaint is in addition to the amended federal complaint filed by the USFDA.

The amended complaint is in addition to several other amended federal and state law claims filed by the pharmaceutical industry against Pfizer.

The alleged violations of the Federal Trade Commission Act are similar to those in the case of Teva Pharmaceutical Industries Ltd. v. Johnson & Johnson Pharmaceuticals LP.

Teva filed a motion to dismiss the amended complaint on July 8, 2018, alleging that it failed to properly conduct a “black-box” warning on the NEXIUM drug and failed to adequately explain its use of the product.

Pfizer said that the new information provided by the USFDA is not appropriate.

“Pfizer’s conduct, in the wake of the proposed settlement agreement with the USFDA, is a blatant violation of the FTC Act,” Lechleiter said. “Pfizer has provided a detailed warning about its marketing practices in the past and has failed to adequately disclose the risks and potential consequences associated with Nexium.”

In response to the amended complaint, Pfizer said that it is not seeking to prevent any liability for any alleged violations of the FTC Act, including those related to the drug. “Pfizer’s continued violations of the FTC Act may result in settlements that are not as good as expected,” Pfizer said.

Pfizer said that it will seek approval to resolve the remaining issues with the USFDA.

Pfizer is currently evaluating a potential settlement in connection with the proposed settlement.
